These Terms of Use & Sale apply to your use of www.nollywoodkids.com and to purchases made through our website, including downloadable educational resources.

By using our website or purchasing a product from our Learning Store, you agree to these Terms.

1. About Nollywood Kids

Nollywood Kids provides children's educational and entertainment content, including videos, activities, printable resources and digital learning products.

For these Terms, "Nollywood Kids", "we", "us" and "our" refers to the business operating the Nollywood Kids website and Learning Store.

2. Using Our Website

You may use our website for lawful purposes and in accordance with these Terms.

You must not:

  • use the website for an unlawful purpose;

  • interfere with the operation or security of the website;

  • attempt to gain unauthorised access to our systems;

  • knowingly introduce malicious software or harmful material;

Products are supplied in digital form unless otherwise stated on the product page.

4. Purchasing Products

When you place an order, you are requesting to purchase the product described on the relevant product page.

Payment must be successfully completed before the digital product is made available for download, unless otherwise stated.

We reserve the right to correct obvious errors in product descriptions, pricing or technical information.

If an obvious error has resulted in an incorrect price being displayed, we may contact you before completing the transaction.

5. Digital Delivery

After successful payment, the digital product may be provided through a download link, email or another electronic delivery method.

Customers are responsible for providing an accurate email address where one is required for the purchase or delivery process.

6. Personal and Educational Use

Unless a product specifically states otherwise, purchasing a digital product gives you a limited, non-exclusive, non-transferable licence to use the product for personal, family, educational or classroom purposes consistent with the product description.

You may:

  • download the product for your own use;

  • print copies for your own personal or educational use;

  • use the activities with children in your care;

  • use the resources in an appropriate classroom or educational setting where permitted by the product description; and

  • make reasonable copies necessary for those permitted uses.

7. What You May Not Do

Unless we have given you written permission, you must not:

  • resell our digital products;

  • redistribute the original digital files;

  • upload the files to another website;

  • publicly share download links;

  • distribute the files through social media or file-sharing services;

  • reproduce the products for commercial sale;

  • remove copyright or ownership notices;

  • claim our original content as your own; or

  • create a competing product substantially based on our materials.

If you are a school, church, organisation, business or other group and require a broader licence, please contact us before purchasing.

8. Intellectual Property

Unless otherwise stated, original content available through Nollywood Kids—including videos, written materials, illustrations, graphics, characters, educational resources, logos, branding and downloadable products—is owned by or licensed to Nollywood Kids or its relevant content creators.

Purchasing a digital product does not transfer ownership of the intellectual property to you.

Your purchase provides the permitted licence to use the product described in these Terms and on the relevant product page.

9. Product Images and Descriptions

We make reasonable efforts to ensure that product descriptions, previews and images accurately represent our products.

Colours and appearance may vary depending on your screen, printer, device or other equipment.

We may update or improve our products from time to time.

10. Educational and Children's Activities

Our resources are designed to support learning, creativity, discussion and educational activities.

Parents, guardians, teachers and other responsible adults remain responsible for deciding whether an activity is suitable for a particular child.

Some activities may require adult supervision, particularly crafts, cooking, physical activities or activities involving tools or other materials.

11. Website Availability

We aim to keep our website available and functioning properly, but we cannot guarantee uninterrupted access.

Prices may change from time to time.

The price applicable to an order will generally be the price displayed when the order is placed, subject to correction of obvious errors.

Payments may be processed through Stripe.

We do not store your full payment card details.

14. Refunds and Consumer Rights

Our Refund Policy explains how we deal with refund requests for digital products.

Nothing in these Terms or our Refund Policy is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

Where Australian Consumer Law or another applicable consumer protection law applies to your purchase, those rights continue to apply.

15. Liability

To the extent permitted by law, we are not responsible for losses resulting from:

  • misuse of our website or products;

  • failure to follow product instructions;

  • failure to provide appropriate supervision for children's activities; or

  • use of a product in circumstances for which it was not intended.

Nothing in these Terms excludes, restricts or modifies liability or consumer rights that cannot lawfully be excluded, restricted or modified.

16. Events Outside Our Reasonable Control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including significant technical failures, internet outages, service-provider failures, natural disasters, government action or other circumstances beyond our reasonable control.

These Terms are governed by the laws applicable in Australia, subject to any mandatory consumer protection laws that apply to your purchase.
